MLR Rebates: Understanding ​​Distribution and Tax Implications

Under the Affordable Care Act, health insurers are required to spend a minimum percentage of premiums on medical care. For Small Group and Individual (IFP) Plans, this requirement is 80%, while Large Group Plans must allocate at least 85% of premiums toward these same categories. If insurers fall short of these spending thresholds, employers with certain plans may be eligible for rebates. These rebates can be used to lower future premiums or as cash refunds for employees. However, employers have only 90 days to decide how to distribute these rebates and should consult with professionals to ensure compliance with tax and labor laws. Biden Administration Finalizes Mental Health Parity Analysis Rules

The Biden administration has released updated rules to ensure health insurance plans treat mental health and substance use disorders equally to medical and surgical conditions. These rules require health insurers and employers to regularly test their plans for parity compliance and to take steps to address any disparities in coverage. The new regulations aim to improve access to mental health and substance use treatment for individuals covered by health insurance plans.

IBX New Member ID Card & Number

As part of a major carrier update, Independence Blue Cross has introduced new member ID cards for the new plan year. Not only is the card itself new, but your ID number has changed too. All family members will receive unique numbers with the last two digits reflecting their relation to you. Remember to bring your new card to all doctor visits and pharmacies – claims won’t be processed without it. But don’t worry, you can also access digital copies of your card online or through the IBX mobile app!

Provide NOCC by October 15 – Medicare Part D Creditable Coverage

Employers offering prescription drug plans to Medicare-eligible individuals need to determine if their plan is considered “creditable coverage” by October 15th of each year. This information helps individuals decide if they need to enroll in a separate Medicare Part D plan. Creditable coverage provides members with important information and may qualify employers for the Retiree Drug Subsidy. Employers can use specific resources to determine their plan’s creditable status and must report this information to CMS.

Compliance Corner! Federal Penalties for Health Plan Violations

The federal Department of Health and Human Services announced new penalty amounts for certain health plan violations that will take effect on January 15, 2025. These increases are separate from potential ERISA violation penalties that the Department of Labor may announce later in the year.
